1. Acceptance of Terms

By accessing our website, enrolling in our programs, or using any services provided by Pinnacle Edge, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

These terms constitute a legally binding agreement between you and Pinnacle Edge. We reserve the right to modify these terms at any time, and such modifications will be effective immediately upon posting. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

2. Definitions

For the purposes of these Terms and Conditions:

• "We," "Us," "Our" refers to Pinnacle Edge, a financial education provider operating in Chiang Mai, Thailand.
• "You," "Your," "Participant" refers to any individual accessing our website or enrolling in our programs.
• "Services" refers to all educational programs, materials, and related offerings provided by Pinnacle Edge.
• "Program" refers to any structured educational offering, including Foundations of Financial Confidence, Navigating Thai Capital Markets, and Holistic Wealth Architecture.
• "Agreement" refers to these Terms and Conditions together with our Privacy Policy and any program-specific terms.

3. Eligibility

Our programs are designed for individuals aged 18 years or older. By enrolling in a program, you represent that you are at least 18 years of age and have the legal capacity to enter into binding agreements.

Programs are delivered in English and require basic English comprehension. While programs are designed for the Thai context, they are open to both Thai nationals and foreign residents in Thailand.

4. Program Enrollment and Payment

4.1 Enrollment Process

Enrollment in programs is confirmed upon receipt of full payment and completion of enrollment documentation. Program capacity is limited, and enrollment is on a first-come, first-served basis. We reserve the right to decline enrollment at our discretion.

4.2 Program Fees

Program fees are stated in Thai Baht and are subject to change. The fee applicable to your enrollment is the fee posted at the time of enrollment. Fees must be paid in full prior to program commencement unless alternative payment arrangements have been explicitly agreed in writing.

4.3 Payment Methods

We accept payment via bank transfer, credit card, or other methods as specified during enrollment. Payment processing may involve third-party service providers subject to their own terms and conditions.

4.4 Cancellation and Refund Policy

If you cancel your enrollment more than 14 days before the program start date, you will receive a full refund minus a 10% administrative fee. Cancellations made 7-14 days before the start date will receive a 50% refund. Cancellations made less than 7 days before the start date are not eligible for refund.

We reserve the right to cancel or reschedule programs due to insufficient enrollment or other circumstances. In such cases, you will receive a full refund or the option to transfer to a future program session.

5. Educational Nature of Services

5.1 Not Financial Advice

Our programs provide financial education and information. They do not constitute financial advice, investment recommendations, or professional consulting services. Content is for educational purposes only and should not be construed as specific guidance for your individual financial decisions.

5.2 No Guaranteed Outcomes

While we strive to provide high-quality educational content, we make no representations or warranties about specific outcomes, financial results, or benefits that may result from participating in our programs. Your financial decisions and their consequences remain your own responsibility.

5.3 Consultation with Professionals

We strongly encourage participants to consult with licensed financial advisors, tax professionals, or legal counsel before making significant financial decisions. Our programs are intended to supplement, not replace, professional advice tailored to your specific circumstances.

6. Participant Responsibilities

6.1 Attendance and Participation

Participants are expected to attend scheduled sessions and engage actively with program materials. Missing sessions may impact your ability to complete the program successfully. While we make efforts to accommodate scheduling conflicts, we cannot guarantee makeup sessions.

6.2 Respectful Conduct

Participants must conduct themselves respectfully toward instructors and fellow participants. Disruptive behavior, harassment, or inappropriate conduct may result in removal from the program without refund.

6.3 Confidentiality

Group programs involve discussion and sharing among participants. You agree to maintain confidentiality regarding other participants' personal information and financial situations shared during sessions.

6.4 Accuracy of Information

When providing information to Pinnacle Edge, you agree to provide accurate and complete information. Inaccurate information may impact our ability to deliver appropriate educational content.

7. Intellectual Property

7.1 Ownership

All program materials, content, instructional methods, and intellectual property remain the property of Pinnacle Edge. This includes workbooks, templates, presentations, and any other educational resources provided during programs.

7.2 Limited License

Upon enrollment, you receive a limited, non-exclusive, non-transferable license to use program materials solely for your personal educational purposes. You may not reproduce, distribute, sell, or create derivative works from program materials without explicit written permission.

7.3 Recording Restrictions

Recording of program sessions (audio or video) is not permitted without prior written consent. Unauthorized recording may result in immediate removal from the program.

8. Disclaimers and Limitation of Liability

8.1 Service Provided "As Is"

Our services are provided on an "as is" basis without warranties of any kind, either express or implied. We do not warrant that program content will meet your specific needs or that it is error-free, complete, or current.

8.2 Limitation of Liability

To the maximum extent permitted by Thai law, Pinnacle Edge shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability for any claims arising from your enrollment or participation shall not exceed the amount of fees you paid for the specific program.

8.3 Financial Outcomes

We are not responsible for any financial decisions you make or their outcomes. Participation in our programs does not create any obligation on our part to monitor your financial activities or intervene in your decision-making.

9. Indemnification

You agree to indemnify and hold Pinnacle Edge, its instructors, and employees harmless from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these terms, your misuse of program materials, or your financial decisions made during or after participation in our programs.

10. Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms and Conditions by reference. By using our services, you consent to our data practices as described in the Privacy Policy.

11. Termination

11.1 Your Right to Terminate

You may withdraw from a program at any time, subject to our cancellation and refund policy outlined in Section 4.4.

11.2 Our Right to Terminate

We reserve the right to terminate your participation in a program for violation of these terms, disruptive behavior, or any other reason we deem appropriate. In cases of termination for cause, no refund will be provided.

11.3 Effect of Termination

Upon termination, your right to access program materials and participate in sessions ends immediately. Sections of these terms that by their nature should survive termination will continue to apply.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms and Conditions are governed by the laws of Thailand. Any disputes arising from these terms or your use of our services will be subject to the exclusive jurisdiction of the courts of Chiang Mai, Thailand.

12.2 Informal Resolution

Before pursuing formal dispute resolution, we encourage you to contact us directly to attempt informal resolution. Many concerns can be addressed through good-faith discussion.

13. General Provisions

13.1 Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any program-specific terms, constitute the entire agreement between you and Pinnacle Edge regarding your use of our services.

13.2 Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these terms will not be considered a waiver of those rights or provisions.

13.4 Assignment

You may not assign or transfer these terms or your enrollment without our written consent. We may assign these terms or transfer our rights and obligations under them at any time without notice.
